1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the StorGuard 360 platform (the "Service"), operated by 360 Risk Partners ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
StorGuard 360 is a technology platform that helps self-storage operators request insurance quotes from carriers through 360 Risk Partners, a licensed insurance broker/producer. The Service is not an insurer. Nothing on the Service constitutes an offer, binder, or contract of insurance. Coverage is provided only by insurance carriers under separately issued policies and is subject to underwriting, eligibility, and carrier approval.
3. Eligibility
You must be at least 18 years old and authorized to act on behalf of the business you represent. By using the Service you represent that you have the authority to submit information and to bind that business to these Terms.
4. Accounts and Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at Bret@360riskpartners.com of any unauthorized use.
5. Quote Requests Are Not Coverage
Submitting information, uploading documents, or receiving indicative numbers through the Service is a request for a quote only. It does not create, extend, bind, modify, or renew any insurance coverage. No coverage exists until a carrier issues a policy and the policy is bound in writing by an authorized producer. We make no guarantee that any quote, coverage, price, or policy term will be offered.
6. Accuracy of Information
You are responsible for the accuracy and completeness of information you provide, including uploaded policy documents and property data. Inaccurate or incomplete information may result in denial of a quote, higher pricing, or — if a policy is issued — rescission or denial of claims by the carrier.
7. Intellectual Property
The Service, including its software, design, and content (excluding content you upload), is owned by 360 Risk Partners and its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY QUOTE OR COVERAGE WILL BE AVAILABLE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL 360 RISK PARTNERS, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
10. Indemnification
You agree to indemnify and hold harmless 360 Risk Partners and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, or (c) the inaccuracy of information you submit.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time by contacting us to close your account.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. The state and federal courts located in Sacramento County, California will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted here with an updated "Last updated" date. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
